Is This Service Right For Me?
The Immigration Act 2014 has removed (and will remove) a number of in- country rights of appeal and as a result, the available challenge or remedy will be via Administrative Review. This is currently only applicable to certain categories but will be rolled out across broader categories in due course.
There is a 14 calendar day time limit to apply for in-country administrative review of a refused application (7 Days where a person is detained). A specified form must be used and the fee is currently £80.00.
A decision will only be overturned if a ‘case-working’ error is identified as part of the review (e.g. applying the wrong immigration rules, calculating points incorrectly etc.). The Home Office has set a target of 28 days for resolution for applications of administrative review.
